On Tuesday, August 13, 2024, the Calcutta High Court assigned the inquiry into the purported rape and murder of a physician at R.G. Kar Medical College and Hospital to the Central Bureau of Investigation.
A division bench presided over by Justice T.S. Sivagnanam stated that, at first glance, there appears to have been no substantial advancement in the investigation of the case. The court noted that it is entirely reasonable to assert that the administration has not supported the victim or the victim's family.
The Court ordered that the case diary and additional records be handed over to the CBI by 10 a.m. on August 14.
The bench additionally encouraged the doctors who are protesting to terminate their strike. "We sincerely acknowledge the sentiments of the physicians at R.G. Kar Medical College. However, we implore you to contemplate ending the agitation to ensure that individuals seeking medical care at the hospital are not adversely affected," stated the bench.
The Chief Justice inquired as to the reasons behind the absence of a murder case registration by the principal at the initial stage, while an unnatural death case was instead opened at the Tala police station.
The Division Bench, comprising Justice Sivagnanam and Justice Hiranmay Bhattacharya, noted that the body of the postgraduate trainee was not discovered on the roadside, suggesting that either the superintendent or the principal of the hospital could have lodged the complaint.
Justice Sivagnanam inquired about the circumstances under which Sandip Kumar Ghosh was appointed as the principal of another medical college just hours after resigning from the hospital where the incident took place.
"The individual you represent ought to be dismissed. He wields considerable influence," remarked the Chief Justice.
The Court inquired as to the reasons for the absence of a recorded statement from the principal of R.G. Kar Medical College and Hospital following the incident.
"Why is there a lack of protection? That statement serves as the foundation... There appears to be a gap," the Court remarked.
The Kolkata Police have initiated an inquiry into the purported rape and murder, resulting in the arrest of a civic police volunteer in connection with the crime. Chief Minister Mamata Banerjee previously set a deadline for the Kolkata Police to resolve the case by Sunday, August 18, 2024; should they fail to do so, she has indicated that the case will be handed over to the CBI.
